  1. Use of this website
  • We want you to enjoy using our website and navigate freely through the content. Please know that should we employ cookies on our website, our web statistics and analytics systems may capture your IP, navigation and pages accessed and other relevant data for marketing purposes. This helps us to improve our online offering and does not capture your personal identification data or information that identifies you personally.
  • Our articles are intended to provide inspiration and guidance in maintaining health and wellness. They are not a replacement for a medical diagnosis or treatment and should not be used as a replacement therapy for such. 
  • Our recipes cannot cater for all body and constitution types. We endeavour to inform on the particular therapeutics of all recipes, however we cannot guarantee the recipes will provide you with the same therapeutic outcomes as are generally achieved.
  • Avoid making any recipes or preparations if you have concerns about their suitability for the recipient. 

 

2. Use of our content

  • Written content that is referenced or used by you for personal or professional purposes, including for the purpose of academic training, must be credited to the author of the article. 
  • Direct sampling and copying of our content is not permitted without written authorisation. 

 

3. Graphics, Videography and Imagery

  • We ask that you do not use video, photography or graphic materials published on our website in any way. Photographs credited to an author remain the copyright of said author.
  • Photography and video credited to Sulin Sze may only be used with written authorisation from the photographer (Sulin Sze) and must always be credited to the photographer.
  • In some circumstances we have used public domain, clinical research or CC imagery. This includes graphics derived from clinical studies for the purposes of illustrating scientific premises or research outcomes.

Herbalwell (ABN 35 821 854 688) (in clinic and online) is committed to protecting any private information you share with us. We comply with the relevant Australian Privacy Principles (APPs) set out in the Privacy Act 1988 (Cth). To understand how your personal information is collected, handled and stored please this privacy policy. By providing your personal information to me, you consent to my privacy policy. 

The term ‘personal information’ in this privacy policy includes information or an opinion about an identified individual that may or may not be documented in material form.

  1. Personal information collected.
  • The personal information we may request from you as my client is purely for the purposes of being able to contact and identify you, along with details of your health
  • Our services are based in healthcare and wellbeing. We also provide supplements and sell medicinal and beauty products to clients. The types of information collected from you includes health and lifestyle information.
  • Should you be requesting employment with Herbalwell, we may require educational and training information from you. 
  • We may collect your full name, date of birth, age, gender, postal address, phone details, email address, emails received from you, text messages received from you, occupation type, health and lifestyle data, prescribed medicines you are taking or have taken, family history and other factors relevant to your health case. Your case notes will record the type of services we have rendered to you.
  • In order to process payment for our services, our payment system will require your payment details such as credit card number.
  • Information requested from you from third parties as part of rendering our services to you, such as pathology and testing results, is also retained by us.
  • Both your personal identifying and health information are only used for the purposes of providing my naturopathic and herbal health service to you, and only with your consent, or as otherwise permitted by law.
  • In some circumstances we may collect personal information from third parties with your consent, is necessary for us to provide the services you request, or where authorised by law. 

2. Method of personal information collection

  • Your personal information may be collected when you sign up to ournewsletter or blog, follow our social media, make a purchase on our website, email us directly or via the contact form on the website, or at the time of an appointment, educational class or workshop with us.
  • In some circumstances it is not practicable to collect personal information from you directly. We may then need to collect your information from a guardian or healthcare provider involved in your health case.
  • If you do not truthfully provide us with personal and health information, we may be unable to provide you with the health and treatment outcomes you are seeking.

3. Use of personal and health information

  • We use your personal and health information to provide services and treatments requested by you:
  • To confirm your identity and to contact you (including to process orders made by you and sending products to you)
  • To collect payment from you
  • To inform you of specials, competitions or specific products and services that may be relevant to you.
  • To better understand our market and how to best serve our key demographics. This market research use of your personal and health information enables us to consistently improve our website, blog and social media content offering and to develop new products.
  • Providing your personal information may be necessary for you to gain access to our social media.
  • To send you questionnaires or diagnostic information from third parties services such as diagnostic labs, as part of a treatment program.
  • To allow us to fulfil any relevant contractual requirements with our contractors
  • To assess an employment application from you
  • We also may use your personal information to comply with legal obligations during the resolution of grievances or disputes with you, should they arise.

4. Storage of personal and health information

  • We endeavour to safely store your personal and health information from misuse, loss or disclosure. We provide reasonable physical and electronic safeguards to secure information collected from clients. Please note that during zoom or online consultations, the transmission of information over the internet is beyond our control. By participating in an online consultation, you accept responsibility for any risk of interference that online transmission may be subject to.  
  • Case files are destroyed after consultations cease within a reasonable time period, unless we are legally required to maintain them. We do not store payment details such as credit card details unless requested by you.

5. Disclosure of personal information

The circumstances under which we may disclose your personal information include:

  • To a third part service provider to assist with the preparation or supply of health services requested by you, or IT support, debt collection or payment systems.
  • Delivery providers to send products to you.
  • Printers and mailing houses that assist us in providing services to you.
  • Employees of Herbalwell where required on a professional basis to assist with the provision of services and products requested by you such as the preparation and postage of a medicine to you.
  • To sponsors of competitions we run.
  • To providers of marketing or advertising services to Herbalwell. The agents may be located within Australia or overseas.
  • Any person to whom Herbalwell business name, operation and/or assets are transferred
  • To legal authorities where required by law including circumstances where we may need to defend our legal rights and where there is a statutory requirement to provide personal information relating to reportable diseases.
  • For marketing purposes to analytic services such as Google Analytics.
  • In order to locate a missing person.
  • In situations where you may be unable to act autonomously and to assist with your health care and safety.

6. Direct marketing materials

  • When you purchase products from us or complete a consultation with us, we will use your personal information to send you emails for new products, services, special offers, competitions, and any future relevant events to your healthcare.  
  • We alone will send you email marketing. On all emails you will find an option to automatically unsubscribe should you wish to.

7. Security of personal information

  • We take reasonable steps to protect your personal information from unlawful disclosure or misuse.
  • Please note that any information you send to us over the internet is sent at your own risk. We cannot promise security of information sent over the internet.

8. Cookies, Google Analytics

  • We reserve the right to use cookies on our website. Cookies do not capture or store your email or personally identifiable information. They identify web requests that you make, your IP, your browser type and date and time of any requests. They help us provide better browsing experiences.
  • We reserve the right to use Google Analytics to analyse audience data to improve our online service and offering. This may include collection of your IP, browser data, operating system, download errors and pages accessed. This assists us in improving our website.

9. Links to third party websites

  • We provide links to third party websites for the purposes of education. Blog articles specifically will link to the providers of clinical studies and evidence to support article content. Ensure that you are comfortable with the privacy policies of such websites before disclosing your personal and health information to them.

10. Access to your personal information

  • To correct inaccurate personal information that we hold about you, please get in touch using our contact page. 
  • Where requests are made to change personal information, we will require you to verify your identity and clearly state the information you wish to have corrected. 
  • Requests for access to the information we hold about you may incur a fee, which we will specify at the time of the request.

 

11. Privacy-related grievances

  • Should you experience any privacy related issues with my services please email your concerns in writing to hello@herbalwell.com.au addressed to Sulin Sze. I consider any privacy issues carefully and seriously. I will then attempt to resolve any issues within 30 days.
  • I take complaints and concerns regarding privacy seriously and will attempt to resolve any concerns within 30 days of receipt of your notification. Should the solution I offer be unacceptable to you, you may wish to lodge your concerns in writing to the Office of the Australian Information Commissioner (OAIC) www.oaic.gov.au.
